Review Policy
We are pleased that you wish to share your Review.
This document sets out the rules for publishing, verifying and moderating Reviews relating to Products or services on the Website, the Google Business profile and Social Media (taking into account the rules applicable on those platforms).
The purpose of this Policy is to ensure clear information and transparency of communication.
Please read this Policy before using the Website or publishing a Review. Acceptance of this Policy is a condition for the publication of a Review.
- DEFINITIONS
- Administrator – the controller of personal data within the meaning of the GDPR, i.e. Kinga Miśkiewicz, conducting business activity under the name Prisma Digital Atelier Kinga Miśkiewicz, Tax Identification Number (NIP): 7331366649, Niesułków Kolonia 59A, 95-010 Stryków.
- Consumer – a natural person purchasing a Product or using services available on the Website for purposes not directly related to their business or professional activity.
- Social Media – external online platforms enabling the publication of content and communication with users, including in particular:

- Review – a subjective assessment, comment, statement or part thereof published on the Website, Social Media or the Google Business profile.
- Review Presentation Policy, Review Policy, Policy,– this document.
- Privacy Policy – a document specifying the rules for the processing of personal data by the Administrator, available at: [*][PM1] .
- Product – any product, service, content, functionality, technology or feature, as well as all related websites and applications offered by the Administrator, whether on a permanent or occasional basis, in particular within the online store.
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
- Website – the website available at [*] [PM2] and all its subpages.
- User – any person visiting the Website, Social Media or submitting a Review via the Google Business profile.

- RULES FOR PUBLISHING REVIEWS
- I publish Reviews relating to my Products, including both positive and negative feedback.
- I take reasonable steps to ensure that Reviews are submitted only by individuals who have actually purchased or used my Products, in particular:
- individuals who have purchased my Products,
- individuals who have used a Product free of charge, including under barter arrangements or other forms of cooperation,
- individuals who have actually used the Product.
- I ensure that Reviews are reliable and reflect real User experiences.
- Negative Reviews, provided they are expressed in a respectful manner, are taken into account and I make reasonable efforts to respond to them as part of my communication.
- Reviews may be collected via:
- a Review form,
- e-mail messages,
- Social Media,
- other forms of communication.
- Reviews submitted via the Review form are published using a tool provided by an external platform (e.g. a post-purchase review plugin), which ensures that only individuals who have purchased or had the opportunity to actually use the Product may submit a Review.
- Access to the Review form may be granted in particular by:
- automatic access following a purchase,
- providing an individual link to submit a Review (e.g. via e-mail or private message).
- Reviews may be presented in various formats, including:
- text – entered directly by the User in the Review form,
- screenshots – Reviews sourced from Social Media,
- other multimedia formats – including video, graphics or PDF files.
- Each Review may be published with:
- a first name and/or surname,
- a pseudonym,
- a profile picture or avatar,
- without disclosing identifying data,
depending on how the Review was submitted.
- By submitting a Review, the User consents to its publication on the Website and in other promotional materials, such as Social Media posts, newsletters or brochures. Such consent may be withdrawn at any time. To withdraw consent, please contact me via e-mail or the contact form. Upon withdrawal, the Review will be removed from the Website and promotional materials within a reasonable time.
- Reviews presented in the form of screenshots or materials sourced from Social Media are published in a fair and non-misleading manner, without altering their content and with clear indication of their source.
- VERIFICATION OF REVIEWS ON THE WEBSITE
- Reviews may be published on the Website either by me or directly by Users via the Review submission form.
- All Reviews are verified for compliance with this Policy and applicable law prior its publication.
- The verification process includes:
- verifying whether the identity of the person submitting the Review corresponds to individuals who have purchased the Product, received it free of charge or under a cooperation arrangement, or otherwise had access to and used the Product,
- restricting access to the Review form exclusively to individuals who have used or purchased the relevant Product,
- ongoing monitoring of submitted Reviews and related reports.
- A Review is published if, following the above verification steps, it is established that the person submitting the Review has actually used or purchased the Product.
- Where reasonable doubts arise, I may request additional confirmation from the person submitting the Review that they have purchased or used the Product.
- Except in cases of legal violations or breaches of this Policy, I do not interfere with the content of Reviews.
- VERIFICATION OF EXTERNAL REVIEWS
- Reviews published on external platforms, such as Facebook or Google, are not subject to my verification. The publication of such Reviews is governed by the rules of the respective platform. However, I monitor content published on these platforms and report any abuse, fake Reviews or content violating applicable law to the platform administrators, for example by using reporting tools provided by Facebook.
- Reviews from external platforms may be marked with information about their source in order to ensure full transparency for other Users.
- MODERATION OF REVIEWS
- I reserve the right to select, refuse publication, or remove Reviews where:
- the content of the Review breaches the rules set out in this Policy, in particular Sections VI.5 and VI.6,
- the Review does not clearly relate to the Product, contains false information, or there are reasonable grounds to believe that it was not submitted by a person who has actually purchased or used the Product.
- In the event a Review is not published or is removed, you may contact me to obtain information on the reason for such a decision.
- You may withdraw your consent to the publication of a Review at any time by either refraining from submitting it or requesting its removal where technical self-removal is not possible.
- Reviews may also be anonymised, in particular where they include personal data.
- Reviews must be:
- authentic and based on the User’s genuine experience with the Product,
- compliant with applicable law and not infringing the rights or personal rights of third parties, including not violating dignity, feelings, or values of others,
- clear and understandable, preferably in Polish or English. To ensure consistency, all Reviews are translated bidirectionally (PL ↔ EN), ensuring identical meaning across language versions.
- Publication of the following content is not permitted:
- content that is offensive, vulgar, defamatory, contrary to good morals, or incites violence or hatred,
- confidential information,
- spam, personal data of third parties, advertising, or external links,
- content that violates applicable law, including copyright, trade secrets, intellectual property rights, or image rights,
- false, misleading, or unrelated content,
- content referring to a discontinued Product.
- I do not publish or commission sponsored, false, or artificially generated Reviews, or Reviews intended to manipulate Product ratings. Reviews provided under barter or other cooperation arrangements are published only if they are authentic, reflect actual experience with the Product, and are clearly disclosed as cooperation-based Reviews.
- LIABILITY
- Users are solely responsible for the content of the Reviews they publish.
- I am not liable for any damages or claims of third parties arising from the content of Reviews, subject to cases where such liability results from mandatory provisions of applicable law.
- COMPLAINTS
- Any User may submit a complaint or report regarding:
- the publication, content, removal, or anonymisation of a Review,
- technical issues related to submitting Reviews.

- The report should enable identification of the User and include a description of the issue, including the date and nature of the event, as well as expectations regarding the proposed resolution. Providing detailed information is recommended but not mandatory. If the report is incomplete, the User will be asked to supplement it.
- Reports will be handled within 14 days of receipt, and a response will be provided in the same form in which the report was submitted, unless the User indicates a different preferred method of contact.
- In connection with handling a report, I may process the User’s personal data in accordance with the Privacy Policy[PM3] , solely to the extent necessary to handle the complaint or report.

- Personal data are processed in connection with the publication of Reviews, e.g. where they include a name and surname, e-mail address, or image. Providing data is voluntary, but may be necessary for the publication of a Review or for contact regarding a Review.
- Personal data are processed in accordance with the GDPR and the Personal Data Protection Act.
- Detailed rules regarding data processing, Users’ rights, information on data recipients, and the use of cookies and other technologies are set out in the Privacy Policy.
- OUT-OF-COURT DISPUTE RESOLUTION
- I express my willingness to resolve any disputes arising in connection with the use of the Website amicably, in particular by means of mediation proceedings.
- The Consumer has the right to use out-of-court procedures for handling complaints and pursuing claims arising from the contract.
- In particular, the Consumer may apply to:
- the regional inspector of the Trade Inspection (Inspekcja Handlowa) with a request to initiate mediation proceedings,
- a permanent consumer arbitration court with a request to resolve the dispute,
- a district (municipal) consumer ombudsman or a consumer protection organisation for assistance.

- POLICY AMENDMENTS
- The Policy may be amended for valid reasons, such as changes in applicable law, technology, the functioning of the Website, or the scope of the offer. The new version of the Policy shall become effective upon its publication on the Website. In the event of any amendment to the Policy, the version of the Policy in force as of the date of submission of a Review shall apply to all Reviews submitted prior to such amendment.
- Users are encouraged to regularly review this document to ensure they are aware of its current version.
- Users will be informed of any material changes to the Policy on the Website or, if necessary, by e-mail.
- Each version of the Policy will be marked with its effective date.
- FINAL PROVISIONS
- In the event that any provision of the Policy is found to be inconsistent with applicable law, this shall not affect the validity of the remaining provisions. In place of the invalid provision, the relevant provisions of applicable law shall apply.
- In disputes with a Consumer or a trader with consumer rights, jurisdiction shall be determined in accordance with applicable law.
- In matters not regulated by this Policy, the provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, the Act on Provision of Electronic Services, the Unfair Competition Act, and data protection regulations, including the GDPR.
